A $35 fee will be assessed for checks which result in insufficient funds.

Claims

Errors in type, species, or color must be submitted within 48 hours of receipt. It is the responsibility of the buyer to inspect all plant material prior to unloading at point of delivery or at time of pick-up. Under no circumstance will Southern View Nursery, Inc. be liable for any amount greater than the original price paid for merchandise. Southern View Nursery, Inc. shall not be responsible for consequential or special damages. Liability will not exceed the selling price of the materials purchased.

Choice of Law Forum

It is agreed by both parties that any contract for the sale of goods and services between Southern View Nursery, Inc. and the Buyer is made in Indiana and shall be governed by Indiana law. Any action pertaining to such sale shall be venued in Shelby County, Indiana.

Limited Guarantee

Plants are warranted to be true to name. Plant material is inspected by the Indiana Department of Natural Resources and certified to be apparently free of dangerous insects and dangerously contagious plant diseases. We warranty our plants to be healthy at time of shipment. All other warranties are specifically excluded, including but not limited to the warranty of merchantability or fitness for intended use and any warranty regarding future growth.

Plant Material Return Policy

Returns of plant material are strongly discouraged to ensure only the highest quality plant materials are sold at Southern View Nursery, Inc. Plant materials may be accepted for return only at the discretion of Southern View Nursery, Inc. management. Ball and Burlap trees and shrubs that have left Southern View Nursery, Inc. or have been off-loaded at the point of delivery may not be returned. Contact must be made within 24 hours of receipt of product to file a case for a qualified return. A re-stock fee of 25% will be assessed on all approved returns.

All boxwood sales are final; once a boxwood leaves our nursery, we are unable to accept returns for any reason. No outside boxwood may be brought onto the property. We will not accept any outside refuse at our facilities or in our dumpsters.

Deliveries

Schedule your delivery at time of purchase. Limitations to scheduling of deliveries may apply based on the availability of equipment and drivers.
